Contempt – Refusal to follow the Court Order

As to the parent:  Fine up to $100 per day for each day the court order is violated; Jail, up to 12 months and up to $2,500 fine; Fine and jail, up to $50 and 10 days in jail as specified.

As to a child 14 years of age or older:  Suspend driver’s license; Order placement out of the home; Detain in secure detention home for up to 10 days per show cause; Order community service time.

Effective July 1, 2000 – Section 16.1-278.9

A. If a court has found facts which would justify a finding that a child at least thirteen years of age has failed to comply with school attendance and meeting requirements as provided in Section 22.1-258, the court shall order the denial of the child’s driving privileges for a period of not less than thirty days.  If such failure to comply involves a child under the age of sixteen, the child’s ability to apply for a driver’s license shall be delayed for a period of not less than thirty days following their 16th birthday.

B. Any child who has a driver’s license at the time of the offense or at the time of the court’s finding as provideded in subsection A shall be ordered to surrender their license, which shall be held in physical custody of the court during any period of license denial.  For a second offense or finding, the court may not review the loss of license until one year after the issuance of the court’s order.
